摘要
德國都市更新制度規定於該國之建設法典中，不僅在理論體系上十分完整，而且制度設計亦面面俱到，誠有供我國借鏡之處。因為我國目前正極力推動都市更新，甚至於已有「都市更新條例」草案之提出。所以本論文仍以德國法之介紹為主軸，旁諸於我國現行都市計畫法中有關都市更新章中之規定，加以比較並分析其優劣，希望一方面有助於我國推動都市更新之際，能掃除對此制度之疑慮及排斥，另外一方面也希望有助於建立我國完整可行之都市計畫制度，使得都市中之不良地區，可以透過都市更新之手段，重獲得第二春之生命力，提高人民居住之生活品質。

Abstract
The urban renewal system in Germany is stipulated in the Building Code (BauGB). This article introduces the said system and compares the related statutes in the Urban Planning Law of the Republic of China. With the German system as a reference, establish the same system in Taiwan so as to renovate the rough region and improve the quality of the resident's life.
