摘要
隨著現代國家任務擴張與憲法功能轉變，財產權的概念內涵亦隨之發生變化。如何從社會理論的角度，探究憲法功能變遷所牽動的財產權概念變化，乃是進行財產權釋義的前提課題。本文試圖透過財產權作為商品與德行兩大思想典範的分析，考察以上兩種思想與憲法基本權利功能由限制到整合此一發展趨勢的關係。另一方面，則以美國聯邦最高法院的兩則判決為例，檢證財產權思想典範改變與憲法功能變遷的具體關聯。本文以為隨著現代國家任務的不斷擴張，憲法基本權利的功能不再限於單純的限制國家權力，更扮演整合社會共識的角色，而此種發展恰好印證財產權由商品典範的強調個人自主，逐步走向德行典範以建構有序社會為重。美國聯邦最高法院的Lochner v. New York 與Goldberg v. Kelly 兩則判決，正代表財產權商品與德行典範的對照，以及憲法功能由限制擴張至整合的發展。

Abstract
With the enlargement of state tasks and the transformation of constitutional functions, the concept of property has been undergoing change. This paper is designed to explore the interrelationship of the paradigm-shift in the concept of property and the transformation of constitutional functions.

According to this paper’s analysis, on the one hand, the paradigmatic concept of property has changed from one of property as commodity to that of property as propriety. On the other hand, the core function of the Bill of Rights has been transformed from limiting governmental powers to integrating social consensus in order to construct a properly ordered society. Through the case studies of Lochner v. New York and Goldberg v. Kelly, the author finds that the Opinions of the Court in the two cases corroborate the interrelational evolution of the paradigm-shift in the concept of property and the transformation of constitutional functions, especially of the Bill of Rights. However, on account of the impact of the globalization of world systems and the increasing complexity of social systems on constitutional functions, the concept of property is sure to dialectically fluctuate between the two paradigms mentioned above.
