摘要
本文共分為五個部分，主題為「歐洲聯盟基本權利憲章」之實踐，本文主要論述三個議題。首先，「歐盟權利憲章」雖然只有人權宣言 (declaration of rights) 之地位，但是實質上卻有人權法典 (bill of rights) 之效力。其次，「歐盟權利憲章」之影響範圍相當廣闊，其影響遍及於歐洲聯盟三個支柱，同時許多立法草案亦將「歐盟權利憲章」納入，因此其影響力將持續之。第三，未來「歐盟權利憲章」非常有可能正式成為歐盟之人權法典。

Abstract
This essay includes five parts whose main theme is the practice of the Charter of Fundamental Rights of the European Union. This essay’s analyses focus on three issues. First, although the Charter of Fundamental Rights appears to merely have the status of a declara-tion of rights, it is in reality becoming the bill of rights for the European Union. Second, the Charter has already had a broad im-pact on the EU, effects which extend to all three pillars of the EU. Many legislation drafts of the EU have also adopted the Charter into their texts; therefore, the effect of the Charter is sure to continue. Finally, it appears highly likely that the Charter will be adopted into the EU Constitution, thus officially becoming the EU’s bill of rights.
