摘要
我們有色情權利嗎？此為自由主義者與部分女性主義者爭論不休的問題之一。對此，麥肯能 (Catharine MacKinnon) 著名的「噤聲論證」(the silencing argument)，實為值得深入探究的論證之一。依麥肯能的噤聲論證，色情刊物使婦女的言論變得沒有價值，並對婦女產生了「噤聲」(silence) 的效果，因此侵害了婦女的言論自由權利。本文將對麥肯能的噤聲論證中「噤聲」的可能意義作仔細考察。本文將主張：麥肯能的噤聲論證是不假思索的把「遭到噤聲」和「言論自由權利遭到侵害」劃上等號 (本文將稱此為「麥肯能假設」)，而這其實是很有問題的假設。因此，麥肯能並未成功說服我們為何色情刊物侵害了婦女的言論自由權利。

Abstract
Catharine MacKinnon, a famous anti-pornography feminist, believes that pornography harms women in a very special and serious way: by silencing them or violating their civil right to free speech. Pornography may thus prevent women from communicating their ideas to others, not by preventing them from producing or distributing sounds and scrawls, but by preventing those sounds and scrawls from being understood by hearers. In this paper, I will argue that MacKinnon fails to show how pornography violates women’s civil right to freedom of speech, and suggest that thus far we remain a long way from showing why pornography harms women.
