摘要
本論文分析美國聯邦最高法院Gonzales 案之判決，焦點著重於不同陣營之論述與對特定概念爭論之知識生產，及這些論述、知識生產背後所反映的意識形態或立場所可能蘊涵及促進之變革。作者深切關心的是本案判決中許多概念之基本範疇認識論 (如「胚胎╱胎兒」、「女人╱母體」之社會建構等) 與世界觀，以及這些理解對女性人權的可能蘊涵。如缺乏對社會結構與平等、正義價值之解析，與對不同認識論之自覺反省，法律與公共政策易淪為政治表態與形式多數表決結果，將可能造成庶民對法律之不信任與疏離感，作者希望在此前提下重新認真看待法律與公共政策。

Abstract
This article provides analysis of the US Supreme Court decision of Gonzales v. Carhart and unpacks issues pertinent to the production and deployment of certain concepts and discourses in different camps on the abortion rights issue in the US. The author employs perspectives inspired by feminist jurisprudence and gender studies, and explores the ideologies reflected in the discourses and knowledge production, and the possible interpretations and changes that could be made in the wake of this decision. Concepts such as fetus, woman/mother, respect for the dignity of human life, and the related world views and the potential implications for the pursuit of women’s rights are also examined in the article.
