摘要
本文從歐洲作為規則產生者的角度，探討在能源憲章公約自荷蘭總理Lubbers之歐盟能源網路、海牙會議之舉行，以及能源憲章公約之簽署與生效過程中，歐盟所扮演之角色。同時間，能源憲章公約之生效，與歐盟之東擴及條約修正同時進行，因而面臨歐盟內部與外部雙邊投資協定大量增加，同時間，外人直接投資因里斯本條約之生效而成為歐盟之專屬權限，此等發展造成歐盟法與能源憲章公約間之潛在衝突，因而本文以Eastern Sugar、Commission v. Austria、Electrabel v. Hungary等案件為例，探討歐盟法與能源憲章公約兩個法秩序之關係。

Abstract
This article examines the role of the European Union “as a rule-generator” in the negotiation and conclusion of the Energy Charter Treaty (ECT) by tracing the European Energy Network proposal advanced by Dutch Prime Minister Ruud Lubbers through the Hague Conference to the signing of the Energy Charter Treaty. This article unfolds the complex relationship between EU law and the ECT by looking at intra- and extra-EU BITs and the status of the ECT as both an intra- and extra-EU BIT. By analysing Eastern Sugar, the Commission v. Austria and Electrabel v. Hungary, this article demonstrates how attitudes have shifted in the relationship between EU law and the ECT.
